Dawah to Khilafah is an Islamic duty of all Muslims, and Those who Persecute the Dawah Carriers are Criminals!

The intelligence officials of Herat province have detained three Dawah carriers of Hizb ut Tahrir for the ‘crime of calling for Khilafah and the unity of Ummah’ during the ongoing month (May) of this year. The intelligence officials, while attempting to arrest one of the Dawah carriers, have mistakenly detained his brother who was returning home from Masjid. When the Dawah carrier goes to the Intelligence Department to release his brother and surrender himself, the intelligence officials put both brothers behind the bars, contrary to the Sharia rules and common traditions of the country. Principally, from an Islamic and legal perspective, when the suspect surrenders himself to the authorities, the person wrongly arrested must be released immediately. Besides, another Dawah carrier has been arrested while he was facilitating Tafseer of Quran in one of Masjids in Herat. First, the intelligence officials of Herat cruelly lashed them and then tortured two of the Dawah carriers by means of ‘waterboarding’ while suffocating another one with a plastic bag.

We condemn such acts of violence against the Muslim Dawah carriers in the strongest terms and consider it to be against all human and Sharia rules and values. Indeed such tortures have historically been practiced in the prisons of the occupiers such as Abu Ghraib, Guantanamo and Bagram; and unfortunately, these cruel practices are apparently being employed by some intelligence circles as an act of imitating the practice of those so-called heinous prisons.

What justification do the intelligence officials have for torturing and persecuting the Dawah carriers? The jurisprudential opinion of the majority of Islamic schools of thought stress the prohibition of torturing the criminals, let alone the torture of Dawah carriers. The leadership of the regime has also explicitly ordered not to use torture in prisons. But in prisons related to the intelligence directorate, these orders are being violated blatantly. By committing such non-Islamic acts, does it imply that the intelligence agencies have turned into an arbitrary institution or are they ever to adhere to Sharia principles? Because those who claim to be practicing Islam, faith and Jihad, their actions and behavior must be bound by Sharia, not the whims of their Nafs.

[إِنَّ الَّذِينَ فَتَنُوا الْمُؤْمِنِينَ وَالْمُؤْمِنَاتِ ثُمَّ لَمْ يَتُوبُوا فَلَهُمْ عَذَابُ جَهَنَّمَوَلَهُمْ عَذَابُ الْحَرِيقِ]

“For those who persecute believing men and women, and do not repent afterwards, there will be the torment of Hell and burning."[Al Buruj: 10]

We realize that inside the regime and also within the top leadership of the Intelligence Directorate, there exist sincere officials who are against such tortures. But their silence and failure to forbid their colleagues from practicing such evil deeds will help spread this sedition (Fitna) widely. So, at the time of rage of Allah (swt), no difference will be made between sincere and insincere elements – everyone will be exposed to the wrath and punishment of Allah (swt).

[وَاتَّقُوا فِتْنَةً لَا تُصِيبَنَّ الَّذِينَ ظَلَمُوا مِنْكُمْ خَاصَّةً وَاعْلَمُوا أَنَّ اللَّهَ شَدِيدُ الْعِقَابِ]

“And guard against the mischief that will not only bring punishment to the wrong-doers among you (rather, if the wrongdoers are not stopped, their sin will burn all innocents and wrongdoers). Know well that Allah is severe in punishment.” [Al-Anfal: 25]

Some officials of the regime think that the survival of the regime depends on banning parties and suppressing Muslim Dawah carriers. Such viewpoint and thinking is not only contrary to the rules and values of Islam, but it will also bear disastrous consequences for the society. Collective and party-oriented activities are natural and necessary phenomena within any human society. History has shown that societies have suffered deep decline and stagnation when they banned the ‘parties, working for awakening the people’. Central Asia, Saudi Arabia and Iran are clear examples of this brutality. In these countries, despite the implementation of anti-Islamic policies, the governments have submitted the people to their illegitimate and non-Islamic policies and have even taken away their courage to enjoin the “maruf” mainly due to the suppression of party-affiliated activities.

In fact, without the activities of the ‘awakening parties,’ the society will be deprived of intellectual, political and jihadist struggle, and people will fall prey to the agendas of foreigners. In fact, it is obligatory for Muslims to struggle collectively under a party for the establishment of the Khilafah (Caliphate) based on the method of Prophethood. On this basis, Hizb ut Tahrir has been struggling globally aimed at establishing Khilafah whose activities stretch from Indonesia to Morocco. Prisons, persecution and torture will not only strengthen the firm determination and endurance of its Dawah carriers but will also boost their energy to continue this duty with unwavering passion.
