To the Participants of the Conference Entitled:
“Kashmir and Occupied Palestine – What is the Solution?”

The approach of ignoring the clear Shariah solution to the Kashmir and Palestine issues in the name of wisdom, expediency and so-called ground realities must be completely rejected.

Whether it is the issue of Kashmir or Palestine, the Shariah solution to the issues is very clear. These are occupied lands of Muslims. The only Shari’ solution is the mobilization of the armed forces to end the occupation of the kafir through Jihad, while the entire Ummah must support these armed forces. The armed forces are the ones equipped with the capability to uproot these occupations. It is the Shari’ obligation upon the entire Ummah in general, and its ‘ulema, Islamic political parties, Muslim leaders and influential people in particular, to advise, incite and compel the armed forces to fulfill this responsibility. Allah (swt) says in the Noble Quran,

[وَاقۡتُلُوۡهُمۡ حَيۡثُ ثَقِفۡتُمُوۡهُمۡ وَاَخۡرِجُوۡهُمۡ مِّنۡ حَيۡثُ اَخۡرَجُوۡكُمۡ]

“Kill them whenever you confront them. Expel them from wherever they expelled you.” [TMQ Surah Al-Baqarah 2:191]. Allah (swt) said,

[يٰۤـاَيُّهَا النَّبِىُّ حَرِّضِ الۡمُؤۡمِنِيۡنَ عَلَى الۡقِتَالِ]

“O Prophet! Rouse the believers to fighting.” [TMQ Surahh Al-Anfal 8:65]. The Shariah Qaidah (principle) is clear that (خطاب الرسول ﷺ خطاب لأمته) “the address to the Messenger of Allah (saw) is address to his Ummah.”

It is explicitly forbidden to refer to the United Nations (UN) regarding the Kashmir issue, because the United Nations is a Taghut, an authority based on other than ruling by all that Allah (swt) has revealed, according to Shariah Law. Referring to the United Nations is inviting the Wrath of Allah (swt). Allah (swt) says in the Noble Quran,

[اَلَمۡ تَرَ اِلَى الَّذِيۡنَ يَزۡعُمُوۡنَ اَنَّهُمۡ اٰمَنُوۡا بِمَاۤ اُنۡزِلَ اِلَيۡكَ وَمَاۤ اُنۡزِلَ مِنۡ قَبۡلِكَ يُرِيۡدُوۡنَ اَنۡ يَّتَحَاكَمُوۡۤا اِلَى الطَّاغُوۡتِ وَقَدۡ اُمِرُوۡۤا اَنۡ يَّكۡفُرُوۡا بِهٖ ؕ وَيُرِيۡدُ الشَّيۡـطٰنُ اَنۡ يُّضِلَّهُمۡ ضَلٰلًاۢ بَعِيۡدًا]

“(O Messenger!) Have you not seen those who claim to believe in the Book which has been revealed to you and in the Books revealed before you, and yet desire to submit their disputes to the judgement of taghut (the authorities who decide independently of the Shariah Law of Allah), whereas they had been asked to reject it. And Satan seeks to make them drift far away from the right way.” [TMQ Surah An-Nisaa 4:60]. Therefore, referring to the resolutions of the United Nations for Kashmir cannot be accepted in the name of wisdom, expediency, or ground realities.

O Islamic political parties, Muslim leaders, influential people and ulema! These rulers have surrendered Kashmir. They are ready to surrender most of the Blessed Land of Palestine to the Jews in the name of a “two-state solution.” They try to hide behind the United Nations, the international community and other authorities of Taghut to protect themselves from the wrath of the Ummah.

So, you must openly state the true stance before the Ummah, and clarify the Shariah’s solution, without any compromise or pretense. The support of the resolutions of the United Nations by Muslims is actually tantamount to supporting these traitorous agent rulers. The Shariah duty upon the ulema is to declare the truth clearly and openly, without any fear. The ulema must not mix truth with falsehood in the name of ground realities. This confuses the Ummah and it does not become unified in the matter of holding the rulers accountable. The Ummah is gaining a level of awareness and realization, due to which the Ummah has overthrown the rulers in Afghanistan, Bangladesh and Syria. The Ummah is beginning to take its affairs into its own hands. Allah (swt) has bestowed you with influence, therefore distinguish the truth from falsehood before the Ummah, so that the Ummah can recognize the traitors. Beware that these rulers and their followers do not lead you to conceal the truth. Allah (swt) said, [وَدُّوۡا لَوۡ تُدۡهِنُ فَيُدۡهِنُوۡنَ] “They (Kuffar) would wish you to be pliant, so that they too may be pliant.” [TMQ Surah Al-Qalam 68:9].

A common unified stance on this issue by all the Muslims who support Islam and desire to see the implementation of the Shariah Law of Allah (swt) will force the rulers to retreat and kneel. Common stances, such as boycotting Jewish and Western products, and demanding the mobilization of armed forces in support of Gaza, have ruined the reputation of the rulers. Such a clear stance on the issue of Kashmir will also be the beginning of burying these rulers along with their regimes. Hizb ut Tahrir/ Wilayah Pakistan congratulates you on holding this conference, and hopes that this conference will issue a declaration of this common stance for the Muslims of Kashmir and Palestine.

[وَمَا عَلَيْنَا إِلا الْبَلاغُ الْمُبِينُ]
