Subject: Reply to Brother/ Al-Nur Hamad and what he Raised about Hizb ut Tahrir

(Translated)

In an interview conducted by your newspaper, Al-Mijhar As-Siyasi, with Al-Nur Hamad, and was published on 10, 11 and 12th September 2017, in which he discussed Hizb ut Tahrir and the establishment of the Khilafah (Caliphate), describing the party and other Islamic parties in a way that is far from the reality of the party, which shows the brother’s ignorance of the party and its ideas and concepts. We will be thankful to you for posting the following reply:

It came in the testimonies of Brother Al-Nur Hamad … In my estimation, the raising of the Islamic slogans such as the establishment of the Shariah law by the Muslim Brotherhood or the Islamic Khilafah (Caliphate) of Hizb ut Tahrir, or the Taliban, or Boko Haram, in their entirety, are slogans that were produced by the shock of the sudden awakening on the scene of the progress of the West and its superiority and defeat to Muslims at all levels, and even the occupation of their countries. The raisers of slogans of "Shariah arbitration" or "the re-establishment of the Khilafah State" were dominated by the obsessive religious sentiment over the sober knowledge and the objective scientific view. The slogans of "Shariah arbitration" or " the re-establishment of the Khilafah" are ambiguous slogans that have arisen from a sense of an overwhelming civil crisis, and it is not surprising if it lacks the practical content and the objective view... etc.). Here, Mr. Al-Nur Hamad appoints himself a judge and a referee for the carriers of Islam and its project (the Khilafah project). He wants democracy as an alternative to Islam, knowing the faults, the decay and the corruption of the Western democracy, so he says: "We need to get our feet out of the Western conceptual shoe to think about building democracy that fits our position in the path of social and economic development of our societies). And we say to him and to others who were smitten by democracy and dazzled by the West: what we need is not to take our feet out of the conceptual shoe of the West, but we really need to get rid of the minds of some of the science and culture advocates in our country from the conceptual Western shoe because this is the right treatment and the beginning of the awakening from the intoxication.

In response to this talk we say:

First, the establishment of the Khilafah is not a slogan raised by Hizb ut Tahrir, but rather it is an obligation on the Ummah to establish it. There is no dispute over this obligation amongst Muslims, for the evidences on the obligation of establishing the Khilafah are extensive. Including the word of Allah (swt):

] فَاحْكُم بَيْنَهُم بِمَا أَنزَلَ اللَّهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ عَمَّا جَاءَكَ مِنَ الْحَقِّ[ "Allah has revealed and do not follow their inclinations away from what has come to you of the truth.”]Al-Maida: 48[. And His (swt) saying: وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلا تَتَّبِعْ أَهْوَاءَهُمْ وَاحْذَرْهُمْ أَنْ يَفْتِنُوكَ عَنْ بَعْضِ مَا أَنْزَلَ اللَّهُ إِلَيْكَ فَإِنْ تَوَلَّوْا فَاعْلَمْ أَنَّمَا يُرِيدُ اللَّهُ أَنْ يُصِيبَهُمْ بِبَعْضِ ذُنُوبِهِمْ وَإِنَّ كَثِيرًا مِنَ النَّاسِ لَفَاسِقُونَ “And judge, [O Muhammad], between them by what Allah has revealed and do not follow their inclinations and beware of them, lest they tempt you away from some of what Allah has revealed to you. And if they turn away - then know that Allah only intends to afflict them with some of their [own] sins. And indeed, many among the people are defiantly disobedient.”]Al-Maida: 49[.

And this ruling by what Allah has revealed cannot be except under the rule of the Khilafah, and this is what the Prophet (saw) indicated in his saying: «كَانَتْ بَنُو إِسْرَائِيلَ تَسُوسُهُمُ الْأَنْبِيَاءُ، كُلَّمَا هَلَكَ نَبِيٌّ خَلَفَهُ نَبِيٌّ، وَإِنَّهُ لَا نَبِيَّ بَعْدِي، وَسَتَكُونُ خُلَفَاءُ فَتَكْثُرُ»، قَالُوا: فَمَا تَأْمُرُنَا؟ قَالَ: «فُوا بِبَيْعَةِالْأَوَّلِ، فَالْأَوَّلِ، وَأَعْطُوهُمْ حَقَّهُمْ، فَإِنَّ اللَّهَ سَائِلُهُمْ عَمَّا اسْتَرْعَاهُمْ»“Bani Israel were ruled by their Prophets. When one died, there would follow another. There will be no Prophet after me, only Khulafaa’.’ They asked Rasulallah, ‘What should we do?’ He said ‘Give them bay’ah, one after the other, and give them their rights, because Allah will ask them about responsibility.” (Narrated by Muslim)

And, his (saw) saying: «مَنْ خَلَعَ يَدًا مِنْ طَاعَةٍ، لَقِيَ اللَّهَ يَوْمَ الْقِيَامَةِ لَا حُجَّةَ لَهُ، وَمَنْ مَاتَ وَلَيْسَ فِي عُنُقِهِ بَيْعَةٌ، مَاتَ مِيتَةً جَاهِلِيَّةً»“The one who removes his hand from obedience he will meet Allah without a proof for himself’ and Whosoever dies without a bay’ah on his neck dies the death of Jahiliyyah.” (Narrated by Muslim). And other Ahadeeth that indicate the necessity of appointing a Khaleefah and an imam for the Muslims. Imam al-Qurtubi mentioned in the interpretation of the verse: ]إِنِّي جَاعِلٌ فِي الأَرْضِ خَلِيفَةً[  “Indeed, I will make upon the earth a successive authority.”]Al-Baqara: 30[.

He said: "This verse is a primary proof for establishing an Imam and a Khaleefah to be heard and obeyed, for unity to be achieved, and for the laws of Khaleefah to be executed. There is no dispute over its obligation amongst the Ummah or the Imams, save what's attributed to al-Asam (lit. deaf), who was deaf to the Sharia, and those who follow his views and Madhhab.").

Second, the progress of the West is not an absolute progress in everything, rather it is backward and declined to the lowest level of bestiality, morally, value wise and even intellectually. The fascination with it is the result of scientific and technological progress, and science and technology have nothing to do with the ideology and thought, for they are a human product, The evidence for this is that Russia (former Soviet Union) has progressed scientifically and technologically despite its intellectual and ideological differences with the capitalist West, as well as China and others who have had the opportunity; and here I mean the possession of the political decision which is lacking in the Islamic Ummah today for its will has been robbed, and its rulers are tools in the hands of the West who plunder through them the country's material and even intellectual wealth. Thousands of Muslims are in the West and their knowledge contributed to the scientific and technological revival of Europe and America. And once the Ummah returns to its Aqeedah and makes it the basis of its life and possessed its political decision it will return as it was the leading country in the world, not only scientifically and technologically, but to give the world an elevated thought that revives it from the depths of animalism the modernized world lives in today, and I do not say civilized, since civilization is high values and concepts of life which the West does not have them today.

Thirdly, the call for the resumption of the Islamic way of life by establishing the second Khilafah state on the method of the Prophethood is not a call based on obsessive passion as claimed by Brother Al-Nur. Rather, it is based upon a firm creed that Allah is the creator and the master of this universe and that He (swt) alone determines for man how to live in this land:[أَلَا يَعْلَمُ مَنْ خَلَقَ وَهُوَ اللَّطِيفُ الْخَبِيرُ]“Does He who created not know, while He is the Subtle, the Acquainted?”]Al-Mulk: 14[.

In fact, Al-Habib (saw) has practically shown this methodology and it was followed by his righteous Khulafaa and those who came after them from the caliphs. And this methodology is guarded by Allah’s protection:]إِنَّا نَحْنُ نَزَّلْنَا الذِّكْرَ وَإِنَّا لَهُ لَحَافِظُونَ]“Indeed, it is We who sent down the Qur'an and indeed, We will be its guardian.”]Al-Hajr: 9[.

There is no incident or event, since Allah (swt) has sent His Messenger Muhammad (saw) until the Hour[of resurrection]comes, but has a rule in Islam, whoever knows it knows it, and whoever is ignorant remains ignorant of it. He (swt) has completed this religion and said:

] الْيَوْمَ أَكْمَلْتُ لَكُمْ دِينَكُمْ وَأَتْمَمْتُ عَلَيْكُمْ نِعْمَتِي وَرَضِيتُ لَكُمُ الإِسْلامَ دِيناً[ “This day I have perfected for you your religion and completed My favor upon you and have approved for you Islam as religion.”]Al-Maida: 3[.

And Allah Almighty says: [وَنَزَّلْنَا عَلَيْكَ الْكِتَابَ تِبْيَانًا لِّكُلِّ شَيْءٍ وَهُدًى وَرَحْمَةً وَبُشْرَىٰ لِلْمُسْلِمِينَ]“And We have sent down to you the Book as clarification for all things and as guidance and mercy and good tidings for the Muslims.”]An-Nahl: 89[.

Fourth: Clearly, Brother Al-Nur Hamad has not read about Hizb ut Tahrir and he knows nothing about it. Thus, he accused it of the lack of sober knowledge and scientific view, for a man is an enemy of what he does not know. Hizb ut Tahrir studied the reality of the Ummah in a profound and enlightened way, and studied Islam legislatively, and then adopted a clear vision of how to bring a radical change based on the Islamic Aqeedah. It presented this in detailed books on governance, internal policy, foreign policy, economics and others for the Ummah to study and adopt. And the party works day and night to bring this to power.

In conclusion, we say to brother An-Nur Hamad, who kept repeating in his testimony the term "religious state", that this term, which came from the West, meaning "to govern in the name of God", does not exist in Islam. The Islamic state is a state for human being governed by humans who have no sanctity but are held accountable by the Ummah if they wrong or misapply Islam, and they have no advantage over any member of the nation, but they are the most heavily burdened, the Messenger of Allah (saw) said:«إِنَّمَا الدِّينُ النَّصِيحَةُ، إِنَّمَا الدِّينُ النَّصِيحَة» قِيلَ: لِمَنْ؟ قَالَ: «لِلَّهِ وَلِرَسُولِهِ وَلِكِتَابِهِ وَلِأَئِمَّةِ الْمُسْلِمِينَ وَعَامَّتِهِمْ»“The deen (religion) is naseehah (advice, sincerity)” We said, “To whom?”. He (peace and blessings of Allah be upon him) said, “To Allah, His Book, His Messenger, and to the leaders of the Muslims and their common folk.” (Narrated by Ahmad in his Musnad).

Finally, we call on Brother Al- Nur Hamad to visit us and take from us directly, and not from hearing about us, so that he is aware of what he says.

We ask Allah to guide us all to the righteous deeds and sayings…
